1. Acceptance of Terms
By accessing or using DOAM ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy and Acceptable Use Policy. If you do not agree to these terms, do not use the Service.
2. Description of Service
DOAM is a global Business Activation OS that provides tools for creating and managing online storefronts. DOAM operates as a marketplace platform, not as a seller of goods or services.
Our services include:
- Business identity generation (logos, bios)
- Public storefront pages
- Product and service management
- Order tracking and management
- Analytics and insights
3. Marketplace Disclaimer
DOAM IS A PLATFORM, NOT A SELLER
DOAM provides the technology platform for businesses to create storefronts and for customers to discover them. We are not involved in any transaction between buyers and sellers. When you purchase from a storefront on DOAM, you are purchasing directly from that independent business, not from DOAM.
DOAM does not:
- Sell products or services directly
- Guarantee product quality, safety, or authenticity
- Process payments between buyers and sellers
- Handle shipping, delivery, or fulfillment
- Warrant that sellers will complete transactions
- Assume liability for seller actions or inactions
4. Account Registration
To use DOAM, you must:
- Be at least 18 years old (or legal age in your jurisdiction)
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be legally authorized to conduct business in your country
5. Fees and Payment
5.1 Subscription Plans
DOAM offers various subscription plans with fees that vary by country. All fees are displayed in your local currency where supported. Subscriptions auto-renew unless cancelled before the renewal date.
5.2 Payment Processing
Payments to DOAM are processed through various payment providers depending on your location (including Paystack, Stripe, and others). By using the Service, you agree to the applicable payment provider's terms.
5.3 Refunds
Subscription fees are generally non-refundable. Refunds may be considered at our discretion if ALL of the following conditions are met:
- Request is made within 7 days of initial subscription purchase
- No products have been published to your storefront
- No AI credits have been used (logo generation, bio generation, etc.)
- This is your first subscription with DOAM (no previous refunds)
AI-generated content (logos, bios, banners) represents consumed resources and is non-refundable once generated. Refund requests are reviewed on a case-by-case basis and approval is not guaranteed.
6. Transactions Between Buyers and Sellers
DOAM does not process, hold, or handle payments between sellers and their customers. All transactions occur directly between the parties via bank transfer, mobile money, or other methods chosen by the seller.
6.1 Seller Responsibilities
Sellers are solely responsible for:
- Product descriptions, pricing, and availability
- Fulfilling orders accurately and on time
- Handling customer inquiries and complaints
- Processing refunds and returns per their stated policy
- Complying with all applicable laws and regulations
- Collecting and remitting applicable taxes
6.2 Buyer Responsibilities
Buyers should:
- Verify seller information before making purchases
- Communicate directly with sellers for questions
- Report suspicious activity through our reporting system
- Understand that purchases are at their own risk
7. Prohibited Content and Activities
Please refer to our Acceptable Use Policy for detailed prohibited items and activities. In summary, you may not use DOAM to sell:
- Illegal products or services
- Counterfeit, stolen, or fraudulent goods
- Adult content or services
- Weapons, drugs, or controlled substances
- Products that infringe intellectual property rights
- Pyramid schemes or fraudulent offers
8. Verification and Trust
DOAM offers verification badges to indicate identity verification status:
- Verified: Identity documents have been reviewed
- Premium Verified: Enhanced verification with business registration
Verification badges do NOT:
- Guarantee transaction outcomes or product quality
- Represent endorsement by DOAM
- Create any liability or warranty by DOAM
- Verify ongoing business practices or conduct
9. Reporting and Disputes
9.1 Reporting Issues
If you encounter a problem with a seller or buyer, you can submit a report through our reporting system. We will review reports and may take action including warnings, suspensions, or permanent bans.
9.2 Disputes Between Buyers and Sellers
DOAM is not responsible for resolving disputes between buyers and sellers.We encourage parties to resolve disputes directly. For serious issues (fraud, non-delivery), contact local law enforcement.
10. Intellectual Property
10.1 Your Content
You retain ownership of content you upload. You grant DOAM a worldwide, non-exclusive license to display this content on your storefront.
10.2 Generated Content
AI-generated content (logos, bios) is licensed to you for business use.
10.3 DOAM Platform
The DOAM platform, including its design, code, and features, is owned by DOAM and protected by intellectual property laws.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
DOAM is provided "as is" without warranties of any kind, express or implied. DOAM, its officers, directors, employees, and agents shall not be liable for:
- Any disputes, claims, or damages arising from transactions between users
- The quality, safety, legality, or availability of listed products/services
- The accuracy of product descriptions or seller information
- The conduct or performance of any seller or buyer
- Lost revenue, profits, or business opportunities
- Indirect, incidental, or consequential damages
- Service interruptions, errors, or data loss
Our total liability for any claim is limited to the amount you paid for the Service in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold DOAM, its affiliates, officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your products, services, or business practices
- Any transaction or dispute with other users
- Your violation of any third-party rights
13. Cancellation and Termination
Voluntary Cancellation: You may cancel your subscription at any time from your dashboard settings. Upon cancellation:
- Your storefront will remain publicly visible for 3 days (grace period)
- After 3 days, your storefront becomes hidden from public view
- Your data (products, orders, settings) is preserved for 90 days
- You can reactivate your subscription within 90 days to restore your store
- After 90 days, your data may be permanently deleted
Subscription Expiration: If your subscription expires and you do not renew, the same 3-day grace period and 90-day data retention policy applies.
Termination by DOAM: We may suspend or terminate your account for violation of these terms or at our discretion. In such cases:
- Your storefront becomes immediately inactive
- Your data may be retained for legal or compliance purposes
- You may request data export within 30 days of termination
14. Governing Law
These terms are governed by the laws of your jurisdiction for consumer protection matters. For other disputes, applicable law of your country applies. Any disputes shall be resolved through arbitration.
15. Changes to Terms
We may update these Terms periodically. Material changes will be notified via email. Continued use after changes constitutes acceptance.
